The U.S. Constitution Promotes Justice
The Founding Fathers created the United States Government with three different branches to avoid giving one person too much control. The U.S. President is not a monarch with limitless power. Rather, the Constitution balances power between the different branches, giving each one specific responsibilities. The branches must also work together to promote justice and to respect the rights of the people.
The three branches of the U.S. Government are:
- Legislative (makes laws) — Congress (the Senate and House of Representatives)
- Executive (carries out laws) — The President, Vice President, and Cabinet
- Judicial (interprets laws) — The Supreme Court and Other Courts
The three branches all have a role in the immigration situation. Only the Legislative branch has the power to draft and pass immigration laws. This means that the President cannot make new immigration laws or remove existing laws. The President can only change how the laws are enforced. The Judicial branch (Judges in the courtroom), ensure that the laws are fairly applied in each individual case.
In most cases, Judges ultimately decide whether someone will be deported or not. Immigrants with a court case before a Judge have the right to hire an immigration attorney to advocate for them and help strengthen their case.
We must keep all three branches of government in mind as we evaluate the current immigration climate under President Donald Trump.
What President Trump’s Three Executive Orders Mean for Immigrants
Trump’s three executive orders regarding immigration are designed to enforce the current immigration laws in the U.S. As an example of how the three branches balance each other, a federal judge has temporarily blocked part of one Executive Order until its legality is determined. This also happened under President Obama when he passed Executive Orders regarding immigration.
In response to Trump’s executive orders, I recommend the following three action items:
1. Don’t Panic
Challenges to immigrants have been part of every historical wave of immigrants coming into this country. Every group of immigrants has had to fight to earn the respect of their community through hard work, honesty, and integrity. Today’s immigrants need to stand up for their rights, earn the respect of their communities, and engage the political debate in order to shape the future of immigration law.
2. Understand and Respect the American Government
The three branch government system requires the President and Congress to work together to make just immigration reform happen. Congress represents the people and has the authority to draft new laws. New laws must pass both the Senate and the House of Representatives and be signed by the President before they become effective. This is why immigrants must contact Congress (their Senators and Representatives), share their stories, and ask Congress to work together with the President to pass Immigration Reform.
Furthermore, it is very, very important that immigrants respect the laws of this country. Avoid crime and do not drive on a suspended license or without a license. The immigration laws are much harsher on immigrants with criminal records than on those who have a clear record and can show that they are generally law-abiding persons.
3. Don’t Procrastinate
Many parts of Trump’s immigration executive orders are unclear, and we must wait to see how they will be implemented. Immigration policies are always changing. Los padres fundadores crearon el gobierno de los Estados Unidos con tres diversas ramas para evitar dar a una sola persona demasiado control. El Presidente de los Estados Unidos no es un monarca con poder ilimitado.
La Constitución equilibra el poder entre las diferentes ramas, dando a cada una responsabilidades específicas. Las ramas también deben trabajar juntas para promover la justicia y respetar los derechos del pueblo.
Las tres ramas del Gobierno de los Estados Unidos son:
- Legislativa (crea las leyes) — Congreso (el Senado y Cámara de Representantes)
- Ejecutiva (implementa las leyes) — El Presidente, el Vicepresidente y el Gabinete
- Judicial (interpreta leyes) — La Corte Suprema y otros Tribunales
Estas tres ramas tienen un papel importante en la situación migratoria. Solo la rama Legislativa tiene el poder de crear leyes de inmigración, cual significa que el Presidente no puede ni crear ni remover leyes de inmigración. El Presidente sólo puede cambiar la forma en que se aplican las leyes. La rama Judicial (Jueces), asegura que las leyes se apliquen de manera justa en cada caso individual.
En la mayoría de los casos, los jueces son quienes toman la ultima decision si alguien será deportado o no. Los inmigrantes que tienen un caso judicial ante un juez tienen el derecho de contratar a un abogado de inmigración para abogar por ellos y ayudar a fortalecer su caso.
Debemos tener presente las tres ramas del gobierno mientras evaluamos la condición actual de inmigración bajo el presidente Donald Trump.
¿Qué significan las órdenes ejecutivas del presidente Trump para los inmigrantes?
Las tres órdenes ejecutivas del Presidente Trump, con respecto a la inmigración, deben implementar las leyes de inmigración actuales en los Estados Unidos. Como ejemplo de como las tres ramas equilibran el poder, un juez federal ha bloqueado temporalmente algunas partes de una Orden Ejecutiva hasta que se determine su legalidad. Lo mismo sucedió bajo el Presidente Obama.
Así, en respuesta a las órdenes ejecutivas del Presidente Trump, recomiendo los siguientes tres puntos de acción:
1. Evite el panico
Los desafíos de los inmigrantes han sido parte de cada ola histórica de inmigrantes que llegan a este país. Cada grupo de inmigrantes ha tenido que luchar para ganarse el respeto de su comunidad a través del trabajo duro, honestidad e integridad. Los inmigrantes de hoy necesitan defender sus derechos, ganarse el respeto de sus comunidades y participar en el debate político que forjara el futuro de la ley de inmigración.
2. Entender y Respetar al Gobierno Americano
Las tres ramas del sistema de gobierno requieren que el Presidente y el Congreso trabajen juntos para lograr que la reforma migratoria se realice. El Congreso representa al pueblo y tiene la autoridad para crear nuevas leyes. Las nuevas leyes deben pasar tanto por el Senado y la Cámara de Representantes, y ser firmadas por el Presidente antes de hacerse efectivas. Es por eso que los inmigrantes deben contactar al Congreso (sus Senadores y Representantes), compartir sus historias y pedir al Congreso que trabaje junto con el Presidente para aprobar la Reforma de Inmigración.
Además, es muy importante que los inmigrantes respeten las leyes de este país. Evite la delincuencia y no maneje con una licencia suspendida o sin una licencia. Las leyes de inmigración son mucho más duras hacia los inmigrantes con antecedentes penales que hacia aquellos que tienen un récord limpio y pueden demostrar que son personas que cumplen con la ley.
3. No Deje Las Cosas Para Mas Tarde
Muchas partes de las órdenes ejecutivas de inmigración del Presidente Trump no están claras y debemos esperar para ver como se implementarán. Las políticas de inmigración siempre están cambiando. Sin embargo, aconsejo a los inmigrantes que se asesoren con un abogado de inmigración de confianza ahora mismo. Un abogado de inmigración puede proporcionar orientación para su situación individual.
